Terms of Service

1. Agreeing to these terms

These terms are a binding agreement between you and Nikolai Altergott, Lange Äcker 1, 71543 Wüstenrot, Germany (“Wednesdate”, “we”, “us”), covering your use of the Wednesdate iOS app. By creating an account you accept them. If you do not accept them, please do not use the app.

This agreement is between you and us, not between you and Apple. Apple is not responsible for Wednesdate or its contents.

2. Who may use Wednesdate

You must be at least 18 years old. You must be legally permitted to use a dating service where you live, and you must not be a registered sex offender or barred from such services by any court or authority.

You may hold one account. Your profile must describe you honestly: your real first name, your real date of birth, and recent photographs of yourself. Do not impersonate anyone. Do not use someone else’s photographs. Your account is yours alone — do not let anyone else use it.

3. How the service works

Wednesdate is a slow dating app. Once each week you may opt in. Every Wednesday our matching system pairs some people who opted in. A match becomes a conversation only when both of you tap Chat.

We do not guarantee that you will receive a match, in any given week or at all. If nobody suitable opted in, or nobody scores as a good enough pairing for you, you will get no match that week and we will tell you. We also do not promise that any match will reply, meet you, or be interested in you. Wednesdate introduces people; the rest is up to you and them.

We may change, suspend, or discontinue any part of the app at any time. We will give notice where we reasonably can.

4. Zero tolerance for objectionable content and abusive behaviour

We have no tolerance for objectionable content or abusive users. Read this section: breaking it will cost you your account.

You must not post, send, or share content that:

• Is unlawful, threatening, harassing, abusive, defamatory, hateful, or invasive of another person’s privacy;
• Is obscene, pornographic, or sexually explicit, or depicts nudity;
• Sexualises, endangers, or in any way involves a minor;
• Harasses, bullies, stalks, intimidates, or incites violence against anyone;
• Promotes discrimination or hatred based on race, ethnicity, national origin, religion, disability, gender, gender identity, age, or sexual orientation;
• Depicts or promotes violence, self-harm, suicide, eating disorders, or illegal drugs;
• Is a scam, a fraud, a solicitation, spam, or an advertisement, including requests for money, gifts, or cryptocurrency;
• Contains another person’s private information, or content you do not have the right to share;
• Infringes anyone’s intellectual property rights.

You must also not: use Wednesdate for prostitution or human trafficking; solicit money from other users; create a false identity or a bot account; scrape, copy, or harvest other users’ photos or information; reverse-engineer or interfere with the app; or use it for any commercial purpose.

5. Reporting, blocking, and what we do about it

Every match and every conversation has a menu offering Report and Block.

• Blocking takes effect immediately. The match disappears, neither of you can message the other, and you will never be matched with that person again.
• Reporting sends the report to us.

We review every report within 24 hours. Where we find objectionable content or abusive behaviour, we remove the content and eject the user — we terminate their account, without refund or notice, and we may prevent them creating a new one. We may act on our own initiative too, without a report. We may preserve information and share it with law enforcement where we believe someone is at risk of harm.

If you are in immediate danger, contact your local emergency services first. In Germany, dial 110.

6. Your content

Your photos and messages remain yours. We claim no ownership of them.

To run the service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display your content: to show your profile to the person you are matched with, to deliver your messages, and to process your photos and profile details through our AI provider in order to generate matches, as described in our Privacy Policy. This licence exists only so that we can operate Wednesdate for you, and it ends when you delete your content or your account — except for copies your match has already received, and for anything we must retain by law.

You confirm that you own or are entitled to share everything you upload, and that it does not infringe anyone’s rights.

7. Meeting people in the real world

Please read this carefully.

We do not verify identities. We do not conduct criminal background checks. We do not screen users. The AI that matches you does not, and cannot, assess whether someone is safe, honest, or who they claim to be.

You are solely responsible for your interactions with other users, online and offline. You meet other users entirely at your own risk. Take the ordinary precautions: meet in public the first time, tell a friend where you are going, arrange your own transport, and do not send money to anyone you have met on Wednesdate — no matter what they tell you.

To the fullest extent the law allows, we are not liable for the conduct of any user, online or in person.

8. Suspension and termination

You may delete your account at any time in the app, under Profile → Account Centre → Delete Account. It is immediate and permanent.

We may suspend or terminate your account, without notice, if you breach these terms, if we reasonably believe you pose a risk to other users, or if we are required to by law. Sections 6, 7, 9, 10, and 11 survive termination.

9. Disclaimers, and the limits of our liability

Wednesdate is provided “as is” and free of charge. To the extent permitted by law, we make no warranty that the app will be uninterrupted, error-free, or secure, that matches will be suitable, or that anyone will like you back.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for intent or gross negligence, for fraudulent misrepresentation, for claims under the German Product Liability Act (Produkthaftungsgesetz), or for any other liability that cannot lawfully be excluded.

Beyond that: where we breach a material contractual obligation — one whose fulfilment is essential to this agreement and on which you may reasonably rely — through slight negligence, our liability is limited to the foreseeable damage typical for this kind of agreement. We are not otherwise liable for slight negligence, nor for indirect or consequential loss, loss of data, or loss of profits.

Your statutory rights as a consumer are unaffected.

10. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the European Union, you keep the protection of any mandatory law of your own country, and you may bring proceedings in your own courts.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Apple

These terms apply to the Wednesdate app licensed to you through the App Store. You may use it on any Apple device that you own or control, as permitted by the Apple Media Services Terms and Conditions, which also apply.

• This agreement is between you and us only. Apple is not a party to it.
• Apple has no obligation to provide maintenance or support for Wednesdate. Support requests go to us — see our support page.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation whatsoever.
• We, not Apple, are responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that it fails to conform to a legal requirement, and claims arising under consumer protection or privacy law.
• We, not Apple, are responsible for investigating and defending any claim that the app infringes a third party’s intellectual property rights.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple has the right to enforce them against you.

12. Payments

Wednesdate is currently free. There are no subscriptions and no in-app purchases. If that changes we will update these terms and tell you before you are charged anything.

13. Changes to these terms

We may update these terms. We will change the date at the top and, for material changes, notify you in the app before they take effect. Continuing to use Wednesdate after that means you accept the new terms. If you do not accept them, delete your account.
